Can a Creditor Place a Lien on My Home?

Friday, Oct 30, 2009

Question: I receive Social Security Disability and owe on a few credit cards. I know they can not garnish my disability. However, can they file a lien on my home?

Answer: There are some states that allow liens to be placed on homes while others prohibit such liens. Liens are prohibited in states that have homestead exemptions. I cannot say for certain whether that can happen because you have not provided me with enough information, such as the state you live in. To find if your state allows
for liens on a property please see State Consumer Protection Laws and Exemptions .
