Options on declaring bankruptcy

Question: My soon to be xhusband and i were declaring bankruptcy back in 2004, however, he burnt the house down to the ground in August of 2004, I found out the insurance would not pay because he burnt it, then I found out that the insurance company did pay the loan off and put the property in their names. (My name was only on loan I recently found outand not on deed) we were married for 11 years and bought the house together. Well, I left in 2004 due to situation and I assumed since the insurance took over posession of the land and barn that it was all settled. Well, I found out yesterday that there is a foreclosure on my credit report dated 11/2006 what do I do now

Answer: Due to the complexity of your situation, I do not know if I can provide any insight that will assist you. Based on what you have told me, it sounds like the insurance company may have paid a portion of

the mortgage, but that there may have been an unpaid mortgage loan outstanding on the property, which foreclosed due to the abandonment of the property. However, with so many factors involved, I cannot say for sure what happened without a lot more information.

I encourage you to contact a qualified real estate attorney to discuss this situation and what steps you should take to resolve this problem. You should contact your state or county Bar Association to request a referral to an attorney who can assist you with this situation. If you

explain the situation to the Bar?s referral service, they can should be able to put you in contact with an attorney who may be able to help you. I believe that you have several options, including credit repair (if the credit report foreclosure is misstated) -- but I don't want to point you in the wrong direction in case I do not have full information.

I wish I could be of more assistance, but I hope that the information I have provided helps you Find. Learn. Save.

Best,
Bill
