It depends on your state of residence. Unfortunately, you did not include you state of residence in your question so I cannot answer your question for certain.

Generally speaking, one does not need an attorney in the Midwest, West, and South when refinancing a mortgage or deed of trust. Many states in the East require an attorney. Your mortgage broker will inform you if an attorney is required in your jurisdiction.
